GENERAL CONDITIONS OF SALE AND SHIPMENT

1. General provisions

These general sales conditions (hereinafter, "General Conditions") apply to all product sales (hereinafter, "Products" or "Product") purchased through the website https://www.melopero.com/ (hereinafter, "Site").

The use of the distance selling service described in these General Conditions is addressed to consumers (hereinafter, "Customers" or "Customer").

The language available to conclude the contract is Italian.

The Customer is required to carefully read the General conditions that have been made available on the Site, in order to allow the storage and reproduction by the Customer pursuant to theart. 12 of the Legislative Decree 9 April 2003, n. 70.

The contracts concluded with Melopero Srls (as defined below) through the Site are governed by Italian law and, in particular, by the Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and from Legislative Decree 9 April 2003, n. 70 (hereinafter, "Ecommerce Decree").

4. Price

Product prices are intended including VAT. All prices are in Euro.

5. Order of Products

The essential characteristics and prices of the Products are shown in the offer for each Product.

There is no minimum purchase.

To purchase the Products, the Customer must complete and send Melopero the order form in electronic format, following the instructions contained in the Site. The Customer must put the Product in the appropriate "cart"And, after having read the General Conditions, with particular reference to the contribution for delivery costs and the methods of exercising the right of withdrawal, and to the Privacy Policy, must select the desired payment method and choose the option"send order"

Before submitting the purchase order, the Customer will have the opportunity to correct any data entry errors by following the appropriate modification procedure contained in the Site. In particular, the Customer has the right to modify the quantity of Products he intends to purchase, adding or eliminating one or more Products from the "cart".

By sending the order, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept the General conditions.

The customer will have the opportunity to view and follow the status of his order through the "Orders" area of ​​his account.

7. Confirmation of receipt of the order

In compliance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of execution of the contract, by email, the confirmation of receipt of the purchase order sent by the Customer.

8. Order ineffectiveness

No contract shall be concluded between Melopero and the Customer if Melopero has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in purchasing the products ordered, or exercises the right of withdrawal in an abusive manner.
In such cases, the order sent by the Customer must be considered as having no effect. Melopero will transmit to the Customer, via e-mail, a communication stating that the Contract has not been concluded, also taking care of the cancellation of any charges and / or expenses charged to the Customer.

11. warranty

All products marketed by Melopero are covered by the legal guarantee of 24 months for private customers and 12 months for companies and VAT number for defects of conformity, pursuant to art. 129) of Legislative Decree no. 206 / 2005 (Consumer Code).

The lack of conformity exists when the product is not suitable for the use for which it is intended, does not conform to the description or does not possess the qualities and / or performances promised by the seller and typical of the product sold, or to the specific qualities and performances required by the consumer when they have been the subject of a specific agreement between the parties.
The guarantee is limited in any case to the simple repair or replacement of the defective components.
All products or parts of them replaced by Melopero will become the exclusive property of the same.
Melopero is not liable to any compensation towards the user or third parties for the consequences deriving from the use of the software or hardware and for direct or indirect damages, accidents to people. Damage caused to distinct goods of our material, loss of profit, damage caused or caused by the deterioration or loss of data recorded by the user.

EXCLUSION OF THE WARRANTY
The interventions and / or repairs and / or any spare parts that are found to be defective due to:

1. tampering;
2. failures caused by negligence and / or inexperience in installation (assembly / wiring / configuration, incorrect, partial or absent);
3. electrostatic discharges, conducted / induced electrical discharges caused by lightning or other phenomena external to the product, radiated electromagnetic disturbances, intermittent or non-continuous energy supply;
4. defects or damage caused by falling, breaking, infiltration of liquids or normal wear and tear;
5. repairs performed by unauthorized persons;
6. use of materials that are not official or not present in the Melopero catalog;

12. Applicable law and competent court

These General Conditions are governed by Italian law and must be interpreted in compliance with Italian laws.

For disputes arising from the interpretation, validity and / or execution of these General Conditions the mandatory territorial jurisdiction will be that of the Rome court.
